Pre-Trial Prep, Case Management etc
All to often it's too late to correct something during trial. Many have been there !. Sometimes a minor item can get overlooked in Discovery and even as far back as initial intake. This may have a large impact on your Trial and your ability to obtain a favorable verdict or outcome.
Working with us pre-trial can identify these items and maybe get them corrected. Often your staff overlooks issues because they just do not know. It's not their fault. Working with Trial Consultants early in a case and indeed throughout, ensures a heightened readiness for trial.

Today's society needs to be engaged !. Gone are the days of waving a document in the air and writing on an easel pad. Multimedia is now very commonplace in today's courtrooms. The fear of too much technology will be perceived as "All about the money", has been replaced with a better way for the Jury to retain the information seen and heard in trial. Summation/Closing Arguments have been supercharged with video clips, Document Call-Outs, Trial Transcript Call-Out from live witnesses.
Lit-Happens® Trial Teams are experts at creating and displaying all the content in Trial. They pull together all the Evidence in a Database and can bring up any part of it for display around the courtroom. Zooming into a paragraph, highlighting a signature, comparing two documents side by side,
Video Deposition Editing
Many times your case does not need anyone in trial, or your Firm is so proactive in your cases that all the video depositions are worked on pre-trial. If the only need is Technical, we can also handle this need.
To Synchronize the Deposition, we only need the Video (of course), a "PTX" file or true ASCII text file (PDF's wil not work)
Once Synchronized, we can take all parties "Page Line Designations, objections, and counter-designations" and make pre-cuts to the video. If the Courts rullings are anticipated quickly then we can make the final edits, if not then we can cut accordingly and finalize the video. Once rulings are applied we can produce something to you that Anyone with a laptop can play in court as a ".mpg" assuming that there is equipment in the court to do so.
If your Firm has Internal people that go to Trial with you to handle Presentation, and you only need the "Heavy Lifting" of Video Editing, we can handle that as well.

Video Deposition Synchronization

So, you have a deposition, and you have a video of the session(s).
How do you display it to a jury in a manner that is acceptable to the court ?
Lit-Happens® can "Syncronize" the Raw Video to the Transcript. This involves Time Stamping each line of the transcript to the video. The final out come of this process can either be used in todays most popular Trial Technology Applications that are used by Lit-Happens® and other Trial Support Companies such as Trial Director®, Sanctions®, and OnCue plus a few others.
Lit-Happens® can also provide a DVD that not only contains all of the work product from Time Syncing the Video to The Deposition, but also allows an Attorney to select PageLines and play specific sections on the fly. This is handy in Hearings and ExParte sessions where setting up equipment is usually not allowed. An Attorney can bring a laptop and run this "special program" from a DVD or a folder residing on the laptop.
TRIAL
Trial Support usually Consists of 2 people full-time on Complex lengthy trials (2 weeks - 3 months or more). For Hearings, or shorter non-complex cases 1 person usually will do aside from equipment setup/teardown. Many factors come into play like the amount of physical paper document boxes that have to go back and forth to the courtroom everyday, the amount of work that the Firm's Staff provide vs what needs to be done by the Trial Team onsite, and many other factors
It really comes down to a case-by-case basis on what is required.
For instance, if there are 20 days of video depositions of a client, it will take a great amount of time to work that video. However if there are agreed upon PageLine designations prior to trial, then that can be done then and frees up someone to handle another task in Trial. Most often the case, Judges rulllings on PageLines come just hours before the video is expected to be played to a jury. One thing that we do as a habit, is to cut the video in a very particular way as to minimize the time spent applying the courts rullings to the video.
